For the past fifty years, according to the National Employment Law Project, the number of part time workers has tripled. (Part time workers are those who usually work under 40 hours per week.) Because of this trend in the labor sector, United States government has acted upon to protect the rights of these part time workers by introducing several laws.

There are basically three well-known laws that have been enacted during the past years by the US government. And these laws are:

Employee Retirement Income Security Act

The Employee Retirement Income Security Act is one law that mainly supports the pension plan a private employee should receive upon his retirement, especially on the part time worker. Many companies define part time workers as employees that work under 40 hours a week and should not be entitled to such benefits like vacation, company pension, health insurance and profit-sharing plans. This law then acts as income support for those who are part time workers when they retire. ERISA states that if the part time worker has completed 1,000 hours of work then he is entitled for a pension.

The Fair Labor Standards Act

According to the Department of Labor, the Fair Labor Standards Act main purpose is to set a standard concerning overtime, recordkeeping, youth employment and minimum wage. The regulations as set in this law are applicable to the private sector as well to all public employees in the local, state, and federal government. Though this laws does not stipulate directly that it applies to part time workers, this law is now considered as applicable to both the full time workers and the part time workers. As of July 2009, the Fair Labor Standards Act establishes the federal minimum wage at $7.25.

Unemployment Compensation Law

Unemployment Compensation Law is designed to address the needs of the part time workers. It is stated that under this law, an employee is entitled to compensation if he got unemployed due for the reason that he is not at fault. Additional probation in this law is the eligibility of the employee for unemployment payments if he used to work as a part time worker.

Around the world, the phenomenon of social networking can be felt inside the working place. It is no longer a secret that employees usually use the likes of Facebook and other social networking tools while they are working. There are a lot of doomsayers predicting that a “parade of terrible” about this concern. One of the points that is debated regarding this issue is the distraction as presented by using this sites while employees get things done for their employers.

Experts on the field of labor and employment, sees the “problem” over the use or overused of social networking sites during working hours as something that is not at all new. Gossiping and shirking from work is done in yesteryears at water cooler, they say. The only difference now is that they are doing it right before their tables and computers. What to do about it? The same as been done before the rise of social networking sites: “thoughtful policy implementation and vigilant managerial oversight.”

New Employment Policies

The solution to the problem of social networking is the creation of new language of policy that will address the issue. This policy should include technology, code of conduct, confidentiality policy and harassment and discrimination policy.

Detailed Description of Social Networking Policy

As the set of general managerial policies are already defined, the detailed descriptions on what should be done about it are many to mention. But to start it off, there should be an unequivocal policy statement concerning the abuse of social media on the grounds of discipline. If an employee repeatedly shirk from work and stay glued on social networking sites to the detrimental of his work obligation then this may be a ground for his or her termination.

The next thing, which is the most important thing concerning the privacy of the employer and the company itself, is the rule on prohibition on disclosure of confidential, even proprietary information, and trade secret of the company to social media sites by its employee. Anybody who transgresses this policy should be meted with proper disciplinary action.

The first thing you need to do once you decided to have your own business is to register, to have it legalized whether it may be in the local or state level. The requirements will depend on what state you are located. It will also depend on the business structure.

You have to create a business name, preferably 3 choices in case there will be other business that is under the chosen business name of yours, so you will still have other option. As an individual, we are given our own name for others to identify who we are, the same with obtaining a business name it will help you and your business be distinguished and be identified.

You may be required by the county office or state to use a fictitious name to avoid confusion on the customers’ part.

You need to fill out a form to register and provide necessary documents to support your registration and pay the necessary fees at a county office. You have to confirm what organization it will be, whether it is a proprietorship, corporation, cooperative, partnership or a non profit organization. After filling the registration name you need to get an Employer Identification Number for tax purposes.

Obtaining business license and permits is also important to complete the legalization of your business. This will allow your business to operate, whether you are providing service or selling products.

Registering a trademark will also protect your business and the service or product that you cater. This is applicable to a company logo or if you have business style of your own and someone copied the exact style then you will have the power to sue them. It may take a year or so for the approval of the trademark but it is worth the wait.

Being disabled sometimes triggers discrimination from those who are not suffering from this kind of condition. More often than not, this discrimination is brought even to the workplace. Many cases have been reported where individuals with disabilities are not given the equal opportunities and benefits in their workplaces.
This is one of the reasons why the Disability Discrimination Act of 1992 was made. This act protects the persons with disabilities from indirect and direct discrimination in aspects of their public lives such as education, access to premises and employment.

In case you have seen a disabled individual being discriminated, you can help them in reporting disability discrimination in employment. There are several ways of lodging your complaint with the Human Rights Commission such as through writing, the hard copy complaint and online complaint form and through email.
Your complaint can also be made in whatever kind of language. The complaint that you will submit must have the following information such as the complainant’s name, telephone number and address, who you are specifically complaining about and the contact details of that individual, what and when it happened and who was involved, what and how you think a law has been violated and if you have already made a complaint to another entity and if yes, what happened.

In written complaints, write your whole complaint and include the relevant documents. The complainant’s name and address is very important and also the contact number. In the hard copy complaint form, you simply need to download the form and fill it up and send it to the address of the concerned office. With the online complaint form, you will also fill up the form and submit it directly to the Human Rights Commission.
These ways of reporting disability discrimination in employment are important for individuals with disabilities to be given the right respect and fairness that they deserve.
